Process of Getting a US Green Card
Getting a green card for labor in the United States is a difficult one. Many of the processes are set up to protect the United States however many are to protect the foreign laborer. The application can take a few months to years to complete and is checked at every door. PERM Labor Certification Board is strict on new coming applicants mostly to keep then from hardship when they arrive as well as the United States from unwanted guests.
The US Government has been making it possible for immigrants to make it to America to work for better benefits but ensuring that the job is valid and up to date is important. If the immigrant gets here and the job are no good he/she may have left all he has to come here for nothing. This will create difficulties while they are here.
The Employer even goes through his own events to get workers to the United States.
Step 1:
Labor Certification- Labor certification is the shortest wait. The employer is required to meet certain requirements.
1. Employer Certification- the employer can not get approval without a notice to hire.
2. The Employer must be providing a legitimate job opening,
3. Worker must meet the actual qualifications.
4. The Employer must pay Prevailing wages.
The Prevailing wages must have an occupation title to be considered for work, they must meet the basic skill level needed to obtain this type of Work visa. The determination Date and the Expiration date! The Employer who is filling out the 9089 form must have tried to justify the hire by applying for the 9089 before the application is filled out and must have completed at least 5 of the criteria job fair, on campus recruiting etc…The US government will afford special handling for teachers.
Step 2:
The Applicant must place a petition I-140 for Alien Worker this process will take another 3-8 months.
Step 3:
The Applicant must fill out I-485 or Register for permanent Residency which takes 12-24 months.
Overall the process takes a grueling 2-3 years for completion. The Employers must go through a crucial process to hire an immigrant also. They usually use this as a last resort for finding employees. Traveling to another country is difficult process however since 9-11 it has become even more difficult, taking their time to weed through the applicants and all helping them.
